This summer, the U.S. Department of Labor (DOL) issued the final rule on Association Health Plans (AHPs).
Dillon Health supports the Trump administration’s action to undo the harmful impacts of the Affordable Care Act (ACA) by promulgating a new final rule on AHPs.
Associations can either use the previous rules or can start an Association Health Plan using the new guidance. The new rule does not affect previously existing AHPs, which were allowed under prior guidance. Such plans can continue to operate as before, or elect to follow the new requirements if they want to expand within a geographic area, regardless of industry, or to cover the self-employed. New plans can also form and elect to follow either the old guidance or the new rules.
Understanding the regulatory environment is only one piece of putting together a successful AHP. Associations need to work with a Broker with a track record of success that understands the nuances of finding a partner insurance carrier and working with health other health insurance agents and health insurance brokers that have long-term relationships with their employer clients. Background:
On Jan. 5, 2018, the DOL issued the proposed rule on the Definition of ‘‘Employer’’ Under Section 3(5) of ERISA—Association Health Plans. The DOL’s press release stated that the proposed rule would increase access for small businesses to offer employment-based health insurance through AHPs and give access to 11 million small business employees and their families who do not have employer-sponsored insurance.
The proposed rule originated from President Trump’s Executive Order 13813, “Promoting Healthcare Choice and Competition Across the United States,” which directed the secretary of labor to consider proposing regulations to expand AHPs.
On March 5, 2018 Mike Dillon, CEO of Dillon Health Inc., submitted comments on the proposed rule to DOL saying that AHPs provide an innovative solution to increasing access to health care for employers and reduce the burden on small businesses that have been affected by the ACA.
